Gyanvapi mosque case Highlights: The Supreme Court on Friday transferred the Gyanvapi mosque case pending before civil judge, senior division, to the court of the Varanasi district judge for trial. Observing that a “slightly more mature” and “seasoned hand” should handle the Gyanvapi mosque case, the apex court suggested that the matter be heard by a district court in Varanasi. “A slightly more seasoned and mature hand should hear this case. We’re not making aspersion on trial judge. But more seasoned hand should deal with this case and it’ll benefit all parties,” the bench said. Stating that the bench is on a joint mission to preserve a sense of unification in the country, the court said once the commission report on the Gyanvapi mosque case is out, there cannot be selective leaks. “We are here in a joint mission to preserve a sense of unification in the country. Once commission report is there, there cannot be selective leaks. Do not leak things to the press. Only judge opens the report,” the SC bench said. The Allahabad High Court Friday adjourned the hearing of the Kashi Vishwanath temple-Gyanvapi mosque case till July 6. The HC was hearing a petition challenging the suit pending in the Varanasi court regarding the dispute. As many as six petitions have been filed in the High Court over the matter. The Varanasi court will resume hearing the case on May 23. The two reports on a videography survey of the Gyanvapi mosque complex, submitted in the Varanasi court Thursday, state that debris of old temples were found at the corner of the northern and western walls outside the barricading, and Hindu motifs such as bells, kalash, flowers and trishul were visible on pillars in the tehkhana (basement). A day after the Supreme Court asked the Varanasi district magistrate to secure the wazu khana area where a Shivling was claimed to have been found during a videographic survey of the Gyanvapi mosque complex, without impeding or restricting the rights of Muslims to offer namaz, the faithful flocked to the mosque for prayers and the mosque committee asked them to perform wazu at home before heading there. In the adjoining Kashi Vishwanath complex, an idol of Nandi, gazing in the direction of the Gyanvapi mosque, has been drawing crowds ever since the claim of the discovery of the Shivling during the survey of the mosque complex. District Magistrate Kaushal Raj Sharma said for the convenience of the faithful who come to offer namaz, an application has been filed in court, seeking direction for shifting a water pipe outside. He said orders of the Supreme Court regarding the matter have been complied with — the top court will hear the matter again Thursday.

Finding religious nature not barred by 1991 law: Supreme Court

It said that the application filed by the mosque committee challenging the maintainability of the suit filed by five female Hindu devotees would be decided on priority by the Varanasi district judge.

Underlining the “complexity of the issues involved in the civil suit” pending before the Civil Judge (Senior Division), Varanasi, on the Gyanvapi dispute “and their sensitivity”, the Supreme Court Friday ordered transfer of the pending proceedings to the District Judge, Varanasi, for “trial and all interlocutory and ancillary proceedings”. It said the suit “should be tried before a senior and experienced judicial officer of the Uttar Pradesh Higher Judicial Service”. Responding to the argument of Senior Advocate Huzefa Ahmadi — he appeared for the Committee of Management of Anjuman Intezamia Masjid, Varanasi — that the process initiated by the Varanasi court was in violation of the Places of Worship (Special Provisions) Act, 1991, the bench of Justices D Y Chandrachud, Surya Kant and P S Narasimha, also said that “ascertainment of the religious character of a place is not barred by… the Act”. The bench said the application filed by the mosque committee, challenging the maintainability of the suit by five Hindu women seeking the right to worship at Maa Shringar Gauri Sthal on the outer wall of the mosque complex, “shall be decided on priority by the District Judge upon the transfer of the suit”. It said its May 17 interim order — when it declined to stay proceedings before the Varanasi court, and asked the District Magistrate to secure the area where a Shivling was claimed to have been found during the videographic survey of the mosque area without impeding or restricting the rights of Muslims to access and offer namaz at the mosque — “shall continue to remain in operation pending the disposal of the application” challenging the maintainability and for eight weeks thereafter “so as to enable any party which is aggrieved by the order of District Judge to pursue its rights and remedies in accordance with law”.

Azam Khan walks out of jail, into everyone’s most-watched list

Imprisoned for the past two years, Azam Khan remained very much a part of the political discourse, especially since the recent Uttar Pradesh results, and the choices he makes now will shape Opposition politics in the coming days in the state.

As he walked out of jail on Friday, all eyes were on senior Samajwadi Party leader and Rampur MLA Azam Khan. Imprisoned for the past two years, Azam Khan remained very much a part of the political discourse, especially since the recent Uttar Pradesh results, and the choices he makes now will shape Opposition politics in the coming days in the state. The results may have proven how overblown the ambitions of SP chief Akhilesh Yadav were, but Azam Khan had passed the political test with flying colours. Contesting from behind the bars, the 73-year-old had won pocket borough Rampur by 55,141 votes, defeating both the Congress’s Nawab Kazim Ali Khan (a long-time rival from the Rampur royal family) and the BJP’s Akash Saxena (a complainant in several cases against Azam and his family members). Even Azam’s son Abdullah, released just days to go for elections, won his seat Suar, by a handsome margin of 61,103 votes. Since the elections, the Azam camp has let it be known that the senior leader is not happy with Akhilesh’s stewardship of the SP. One of the closest aides of SP patriarch Mulayam Singh Yadav, Azam – his team said – felt he had been abandoned by the party during his incarceration. In a more incisive charge, they suggested that it was part of the SP’s gradual distancing from Muslims. Many within the party, however, say the differences between Azam and Akhilesh stem from something smaller – the Rampur Lok Sabha seat, which was vacated by Azam after he was elected as MLA. SP leaders say Azam wanted the SP to nominate someone from his family for the constituency, while Akhilesh floated the idea of picking someone else. While both Azam and son Abdullah are already MLAs, his wife Tanzeen Fatima has been an MLA and Rajya Sabha member in the past.
